Terms and Conditions for Trust Reviews

1. Acceptance

By using the Trust Reviews App ("App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you may not access or use the App.

2. Use of the App

2.1 You may use the App only for lawful purposes and in accordance with these Terms.

2.2 You agree the App is owned and operated solely by Ryan Smith as a personal project. References to "Trust Reviews", "we", and "us" in these Terms mean Ryan Smith.

2.3 You agree not to:

• Reverse engineer, decompile, disassemble, or modify the App.
• Use the App to violate any law or regulation.
• Use the App to harm, threaten, or harass others.
• Use the App to impersonate any person or entity.
• Use the App to interfere with the operation of the App or any other user's enjoyment of the App.
• Transmit any viruses or other harmful code through the App.
• Attempt to identify which reviewer gave which feedback.
• Attempt to uncover, or manipulate, how scenario answers are reviewed, for example by including instructions for the AI in an answer.

2.4 If you use the App on behalf of an organisation, you confirm that you are authorised to do so, and these Terms apply to both you and that organisation.

3. User Content

3.1 You may be permitted to submit content (text, reviews, ratings, contact details, etc.) to the App ("User Content").

3.2 You are solely responsible for your User Content and represent that you have the right to submit such User Content.

3.3 When you add the details of coworkers or reviewers, you confirm that you are allowed to share their information with the App and that they would reasonably expect to receive emails asking them to take part in a peer review.

3.4 Scenario answers should describe what you have done or would do without naming or identifying other people, or including confidential information belonging to your employer or anyone else.

3.5 You grant Trust Reviews a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, publish, and distribute your User Content solely to provide the App to you and the people you invite to take part in reviews.

3.6 You agree not to submit User Content that is:

• Defamatory, obscene, hateful, or threatening.
• Infringes on the intellectual property rights of any third party.
• Violates any law or regulation.

4. AI Summaries and Scenario Reviews

4.1 Review summaries and manager notes are generated using AI and may be inaccurate or incomplete. They are intended to support conversations about feedback, not to replace your own judgement. You should not rely on them as the sole basis for decisions about anyone's employment.

4.2 Scenario reviews, their scores and bands, and any badges shown for assessments are generated using AI and are intended to help you reflect on your skills. They may be inaccurate, are not a professional qualification or certification, and should not be relied on as the sole basis for decisions about anyone's employment.

5. Subscriptions and Payments

5.1 Some features of the App, or higher usage limits, may require a paid subscription. Current plans and prices are shown on the Pricing page.

5.2 Subscriptions are managed by Clerk Billing and payments are processed by Stripe. Prices are charged in US dollars (USD $) and subscriptions renew automatically at the end of each billing period until cancelled.

5.3 You can cancel your subscription at any time from your account or organisation settings. Cancellation takes effect at the end of the current billing period and you will keep access to paid features until then.

5.4 Prices may change from time to time. Any change will be notified to you in advance and will apply from your next billing period.

6. Disclaimers

6.1 The App is provided "as is" and without warranty of any kind, express or implied. To the extent permitted by law, Trust Reviews disclaims all warranties, including but not limited to the warranties of merchantability, fitness for a particular purpose, and non-infringement.

6.2 Trust Reviews does not warrant that the App will be uninterrupted or error-free.

6.3 Trust Reviews does not warrant that the App will be secure from unauthorized access or misuse.

7. Limitation of Liability

7.1 To the extent permitted by law, Trust Reviews shall not be liable for any damages arising out of or in connection with your use of the App.

7.2 To the extent permitted by law, this limitation of liability shall apply to all damages, including but not limited to direct, indirect, incidental, special, consequential, and punitive damages.

7.3 Nothing in these Terms excludes or limits any liability that cannot be excluded or limited by law, including liability for death or personal injury caused by negligence, for fraud, or your statutory rights as a consumer.

8. Termination

8.1 You may stop using the App at any time and request that your account is deleted by contacting us.

8.2 Trust Reviews may suspend or terminate your access to the App if you breach these Terms, or for any other reason with reasonable notice where possible.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales.

10. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Trust Reviews with respect to the use of the App.

11. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.

12. Waiver

No waiver of any breach of these Terms shall constitute a waiver of any other breach.

13. Updates to the Terms

You will be notified via email of any significant changes to the Privacy Policy and/or Terms. Amendments are effective on the earlier of (i) 14 days after notification of the changes to you or (ii) when you next use the App.
